Copyright and Reserve Material

Hedberg Library staff can process the following without obtaining copyright permission: exams, lecture notes, and government documents.  The Library can also process one copy of an article from a single journal issue, one chapter from a book, one short story, essay or poem.  In order to place multiple paper copies of the aforementioned materials on reserve, the following guidelines must be met:

  • the material must contain a notice of copyright
  • the amount of material copied is reasonable in relation to the total amount of material assigned for one term of a course [Title 17 Section 107(1) and (3)]
  • the number of copies is reasonable in relation to number of students enrolled [17 U.S.C. Section 107 (1) and (3)]
  • the effect of photocopying is not detrimental to the market for the work [it is preferable that the library own at least one copy of the work; 17 U.S.C. Section 107 (4)]

In order to comply with copyright guidelines library staff require that:

  1. Faculty sign a form that they have read the guidelines and prohibitions for copying and understand that copies of material placed on reserve must conform. This form will be submitted annually in the Fall at the beginning of each academic session.
  2. Items placed on reserve must either be owned by the library or be purchased or legally reproduced personal copies.
  3. The library will arrange copyright permissions for photocopied materials through the Copyright Clearance Center .  If copyright permissions cannot be arranged, the photocopied item will not be placed on reserve.
  4. The library will not place materials borrowed from other libraries on reserve.
  5. The library will not accept home-recorded, “off-air” tapes of broadcast programs for the reserve collection unless specific and adequate copyright permissions can be verified and arranged.  The library will work with faculty to locate and purchase a commercial recording of the program to place on reserve.
  6. No anthologies created without express permission of the individual copyright owners will be processed for Reserves.
  7. Any material photocopied from a workbook will not be placed on reserve.
  8. If library staff deem the material is an infringement of copyright law, material will be returned and faculty will be asked to obtain permission from the copyright holder.
  9. The number of copies of an article shall be in proportion to the number of students enrolled in the class (e.g. one copy for each ten students enrolled).
  10. All material will be removed from reserves and returned to the faculty at the end of the school year. unless the course will be taught during the summer.
  11. Material should not be placed on Reserves from term to term without permission from the copyright holder.
  12. If faculty are concerned about personal copies of commercial media being damaged, Media Services can make one copy for the reserve shelf.  The original, however, must be held at the circulation desk while the copy is on reserve to comply with copyright laws.
